GENERAL TERMS AND CONDITIONS

 

 General terms and conditions of CURREX GmbH ("CURREX") for orders placed in the online shop

1. Scope of application, general

These General Terms and Conditions ("GTC") form an integral part of all contracts concluded by CURREX online with a consumer ("Customer") for goods offered by CURREX in its online shop. By placing an order in the online shop, the customer agrees to the validity of these General Terms and Conditions. Entrepreneurs within the meaning of § 14 BGB are not entitled to place orders.

Invoices within the meaning of § 14 UStG are not issued.

2. Conclusion of contract

The customer can select goods from CURREX's online range of products and place them in a so-called shopping cart by clicking on the "Add to cart" button. By clicking on the "CASHIER" button, the customer submits a binding request to order the selection he has made. Before sending the order, the customer can view and change the data at any time. However, the request can only be submitted and transmitted if the Customer has previously confirmed the order by placing the "✔" in the box in front of the text "I AGREE TO GENERAL TERMS AND CONDITIONS ZU" has accepted these terms and conditions and thereby included them in his application.

CURREX will then send the customer an automatic confirmation of receipt by e-mail, listing the order and which the customer can print out by selecting the "Print" menu item. The automatic confirmation of receipt also constitutes acceptance of the order by CURREX. The text of the contract will be stored by CURREX in compliance with the data protection regulations.

The contract is concluded exclusively in the German language.

For deliveries to Switzerland, the purchase contract is concluded between the buyer and MeinEinkauf AG, St. Gallen (CHE-331.561.017 VAT). The latter also handles customs clearance, invoicing and delivery in Switzerland. This service is included in the purchase price and any shipping costs charged. In order to ensure smooth shipping, MeinEinkauf GmbH in DE-Konstanz (DE285677365) is integrated into the retail chain. This does not result in any additional costs for the buyer.

3. Delivery

CURREX shall not be obliged to deliver goods ordered by the customer if the goods have been duly ordered by CURREX but not delivered (congruent hedging transaction), without CURREX being at fault or CURREX having expressly assumed the procurement risk. Any payments already made by the customer shall be refunded immediately.

CURREX only delivers to customers who can provide a shipping address in one of the following countries: Austria, Croatia, Czech Republic, Denmark, Belgium, Estonia, Finland, France, Germany, Hungary, Ireland, Italy, Lithuania, Luxembourg, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, United Kingdom.  

4. warranty

The warranty for material defects or defects of title of delivered goods is based on the applicable legal regulations, in particular §§ 434 ff. BGB.

5. liability

CURREX is liable for damages - irrespective of the legal basis - in the event of intent or gross negligence. In cases of simple negligence CURREX shall only be liable

a) for damages resulting from injury to life, body or health

b) for damages resulting from the breach of an essential contractual obligation (obligation whose fulfilment is essential for the proper execution of the contract and on whose compliance the customer regularly relies and may rely).

Insofar as CURREX is liable for damages on the merits, such liability shall be limited to damages which CURREX foresaw at the time of conclusion of the contract as a possible consequence of a breach of contract or which CURREX, taking into account the circumstances known to it or which it should have known, should have foreseen when exercising due care and diligence. Furthermore, indirect and consequential damages resulting from defects in the delivered goods shall only be eligible for compensation to the extent that such damages are to be expected when the goods are used for their intended purpose.

The above limitations of liability shall not apply if CURREX has fraudulently concealed a defect or has assumed a guarantee for the quality of the service. The same applies to claims of the customer under the German Product Liability Act.

The foregoing provisions shall also apply in favour of CURREX's legal representatives and vicarious agents if claims are made directly against them.

6. retention of title

All goods delivered by CURREX remain the property of CURREX until full payment has been received.

7. prices/payment modalities

The prices quoted in the online shop are gross prices including the statutory value added tax and plus any shipping costs that may be incurred. The total price including shipping costs is displayed before the order is placed. 

The purchase price is due upon conclusion of the contract.

The customer can pay by credit card, on account, by instant bank transfer, Paypal or Amazon Pay.

In cooperation with Klarna AB (www.klarna.de), Sveavägen 46, Stockholm, Sweden, we offer invoice purchase and instant bank transfer as payment options. Please note that Klarna Invoice is only available for consumers and that payment must be made to Klarna in each case.

When buying on account with Klarna you always get the goods first and you always have a payment period of 14 days.

8. miscellaneous

These General Terms and Conditions and all legal relations between the contracting partner and CURREX shall be governed by the laws of the Federal Republic of Germany to the exclusion of international law, in particular the UN Convention on Contracts for the International Sale of Goods. 

Alternative dispute resolution: The European Commission provides a platform for online dispute resolution (ODR). You can find this at https://ec.europa.eu/consumers/odr/. CURREX is not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.

For all sales on the Amazon platform, the CURREX brand works hard to ensure that only authentic, high-quality products reach the consumer in the condition we intended. Therefore, the CURREX brand offers a 60-day satisfaction guarantee for all sales on the Amazon platforms, which is NOT provided without presentation of valid proof of purchase directly from the CURREX brand or sold through Amazon. If you purchased from an unauthorized third-party seller, you must contact that seller for refunds or replacements. Any CURREX item purchased from an unauthorized third-party seller is not considered an original CURREX product.
